These Terms and Conditions (the “Terms” or “Agreement”) govern your access to and use of the website located at www.honeymoons.com (the “Site”), related services, and any travel planning, referral, support, or booking services made available through the Site (collectively, the “Services”).
The Site is a copyrighted work owned by Campbell Online Media LLC (the “Owner,” “Honeymoons.com,” and/or “we,” “us,” “our”). These Terms govern the relationship between the Owner and you, the purchaser or traveler (“Client,” “passenger,” and “you,” “your”).
By accessing, downloading, or using the Services, creating an account, requesting travel planning assistance, or booking travel through Honeymoons.com, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the Services.
Honeymoons.com may operate in different roles depending on the booking path, including:
- as a travel advisor / booking agent for disclosed principal suppliers in connection with agency-assisted bookings; and/or
- as a platform facilitator and customer support provider for self-service hotel bookings, where Nuitée International Ltd. (“Nuitee”) is the merchant of record and may process payment and booking fulfillment for eligible bookings.
These Terms include important provisions regarding liability, disclaimers, dispute limits, and risk allocation that may restrict your rights and remedies.
1. Eligibility, Acceptance, and Capacity
By accessing or using the Services, you represent and warrant that:
- you are at least eighteen (18) years old;
- you have the legal authority and capacity to enter into this Agreement;
- if acting on behalf of another person or entity, you have authority to bind them; and
- you will use the Services in accordance with these Terms and applicable law.
We may monitor access to and use of the Services in accordance with our Privacy Policy to determine compliance with these Terms.
2. Scope of Services and Booking Paths
Our Services may include, without limitation:
- travel information, content, recommendations, and search tools;
- links and referrals to third-party travel providers and suppliers;
- agency-assisted travel planning and booking services;
- self-service hotel booking functionality; and
- customer support in connection with bookings made through Honeymoons.com.
Different provisions of these Terms apply depending on how you book travel. In particular:
- Sections 1–12 and 20–31 generally apply to all users and Services;
- Sections 13–15 apply to agency-assisted bookings; and
- Sections 16–19 apply to self-service hotel bookings through Honeymoons.com’s booking platform.
3. Accounts, Login Credentials, and Account Security
Certain features of the Services, including member-only pricing or booking functionality, may require you to create an account.
If you create an account, you agree that:
- all registration and account information you provide will be true, accurate, current, and complete;
- you will promptly update your information as needed;
- you are responsible for maintaining the confidentiality of your login credentials;
- you are responsible for all activity under your account, whether or not authorized by you; and
- you will notify us promptly of any suspected unauthorized access or use of your account.
We reserve the right to suspend, restrict, or terminate accounts at any time, with or without notice, including for suspected fraud, abuse, misuse of access, violation of these Terms, or suspected unauthorized use.
4. Closed User Group / Member-Only Access (If Applicable)
Access to certain rates, pricing, or booking functionality may be restricted to members of a closed user group (“CUG”) or other eligible user category, as determined by Honeymoons.com.
By accessing member-only rates or booking features, you represent and warrant that you satisfy the applicable eligibility requirements. We reserve the right to deny, revoke, suspend, or terminate access to member-only features or pricing at any time, including if we believe you are not eligible or are misusing such access.
5. Informational Content, Third-Party Links, and External Websites
We and our affiliates may provide a venue through which you can obtain information about travel products and services offered by suppliers and third parties. Any opinions, advice, information, data, text, and other materials or links made accessible through the Services may be provided for informational purposes only.
The Site may contain links to third-party websites or services that are not owned or controlled by us. We do not control and are not responsible for the content, terms, privacy practices, or business practices of any third-party websites or services.
Your decision to access or connect to any supplier or third party via links or advertisements is at your own risk. When you link to a third party, the third party’s terms and policies apply, including privacy and data collection practices. You should make whatever investigation you feel necessary before proceeding with any transaction with a third party.
6. Intellectual Property
The Site and its original content, features, and functionality are and will remain the exclusive property of Campbell Online Media LLC and its licensors. The Site is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
7. Advertising, Affiliate, and Commercial Disclosure
We may receive referral fees, commissions, or other compensation from suppliers, travel providers, or partners whose products or services appear on or are linked from our Site or Services, including in connection with bookings or referrals.
Compensation received may influence the placement, presentation, or content of certain travel products or services on the Site. However, any product claim, statistic, quote, or other representation about a product or service should be verified with the applicable provider or supplier.
Search results may be ordered by third-party service providers and/or by criteria such as customer reviews or relevance. In some cases, we may also display paid placements or sponsored listings, which may be labeled as “Ad” or with similar disclosure language.
8. Use of Services for Travel Bookings; Accuracy of Information
You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings through Honeymoons.com. You agree to be financially responsible for all bookings made by you or under your account, including bookings made on behalf of other members of your traveling party.
You warrant that all information supplied by you (for yourself or others for whom you are authorized to act) is true, accurate, and complete, including traveler names, dates of birth, contact information, and travel details.
You agree that you will make only legitimate reservations or purchases. Speculative, false, abusive, or fraudulent bookings are prohibited.
Separate supplier terms and conditions apply to travel goods and services you select. By booking travel through Honeymoons.com, you agree to the terms and conditions of the applicable supplier(s), and you agree to comply with all applicable supplier rules, restrictions, cancellation policies, and fare/rate conditions.
9. Right to Correct Errors; Pricing and Availability
We reserve the right to correct errors, including pricing, content, or display errors. In the event of any error or omission, we reserve the right to correct such error, adjust pricing, or make other corrections, including after a request is submitted, subject to applicable law and the policies governing the applicable booking path.
All offers, incentives, rates, and supplier promotions are subject to availability and may change without notice.
10. Travel Documents, Identification, and Accuracy of Booking Information
It is the responsibility of each Client to obtain and carry a valid passport, visa(s), and all other documents required by applicable government authorities and suppliers. Passport cards are not accepted for most international travel.
When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) require acceptable identification in order to board a flight. Acceptable identification may be found at https://www.tsa.gov/.
Certain countries may refuse entry if a passport expires within six (6) months of the anticipated return date. Non-U.S. citizens may require additional documentation. You are responsible for confirming all destination and transit requirements.
The name, date of birth, and gender on your identification must exactly match the information on your reservation and travel documents. Any discrepancy may result in denied boarding, delays, or other losses for which you are responsible.
WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS OR CONFIRMATIONS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY AND TO CONTACT HONEYMOONS.COM PROMPTLY IF CHANGES OR CORRECTIONS ARE REQUIRED.
11. Health, Entry Requirements, Risks, and Safety
You are responsible for understanding and complying with all entry/exit requirements, health requirements, vaccination requirements, and destination-specific advisories applicable to your travel.
We recommend reviewing official travel and health resources, including the U.S. State Department and CDC travel websites:
Travel to certain destinations may involve greater risk than others. By offering travel to particular destinations, Honeymoons.com does not represent or warrant that travel to such destinations is advisable or without risk. You assume the risks associated with travel, including risks arising from destination conditions, government actions, public health events, and supplier decisions.
12. Air Travel; Supplier-Controlled Services
Your airline ticket is a contract between you and the airline carrier, even if purchased through Honeymoons.com. Honeymoons.com does not control the operations of independent airlines or other suppliers and is not responsible for supplier acts or omissions, including delays, cancellations, schedule changes, baggage policies, seat assignment changes, bankruptcy, or cessation of operations.
Seat assignments are not guaranteed even if assigned in advance. Frequent flyer mileage accrual and upgrades are at the discretion of the airline and fare rules.
We recommend reconfirming flight times directly with the airline prior to departure and arriving at the airport within the timeframes recommended by the airline and applicable authorities.
13. Agency-Assisted Bookings: Agency Role and Supplier Relationship
This Section 13 and Sections 14–15 apply to bookings where Honeymoons.com (or its travel advisors/agents) assists you in planning or booking travel.
For agency-assisted bookings, Honeymoons.com acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation providers, boat purveyors/owners, and other independent contractors providing accommodations, transportation, and other services (collectively, “Suppliers”). Honeymoons.com is not the source or provider of those travel services.
Each Supplier is an independent entity with its own management and is not subject to the control of Honeymoons.com. The Suppliers named in your travel documents are responsible for the travel services purchased.
14. Agency-Assisted Bookings: Payments, Cancellations, and Changes
You are responsible for all charges, fees, duties, taxes, and assessments arising out of agency-assisted bookings.
By submitting a credit card authorization form or otherwise authorizing payment for an agency-assisted booking, you authorize Honeymoons.com to use your payment method to purchase travel products from Suppliers on your behalf, where applicable.
All payments are due in accordance with the applicable Supplier’s terms and conditions. Failure to make payment when due or violation of Supplier terms may result in cancellation of reservations, denial of access to travel services, or forfeiture of amounts paid.
Some bookings may be non-refundable once booked or once under deposit. If you change or cancel travel after confirmation, you may not be entitled to a refund. Honeymoons.com and/or Supplier cancellation and change penalties may apply.
Requests for changes or cancellations for agency-assisted bookings should be sent to Honeymoons.com in writing. We will attempt to assist, but certain bookings may not be changeable.
EXCEPT IN CASES OF FRAUD OR AS OTHERWISE REQUIRED BY LAW, YOU AGREE NOT TO INITIATE A PAYMENT DISPUTE OR CHARGEBACK TO AVOID OR VIOLATE THE APPLICABLE BOOKING TERMS, CANCELLATION POLICIES, OR CHANGE FEES OF HONEYMOONS.COM OR ITS SUPPLIERS.
If you initiate an improper chargeback, reversal, or recollection of a previously authorized payment, Honeymoons.com reserves the right to seek recovery of associated costs and expenses, including reasonable attorney fees, to the extent permitted by law.
15. Agency-Assisted Bookings: Independent Arrangements
Honeymoons.com is not liable or responsible for arrangements made independently of Honeymoons.com. We assume no responsibility for costs or fees you incur for independent arrangements not booked through Honeymoons.com, including airline, hotel, excursion, and travel protection related charges.
If you make your own flight or other travel arrangements, Honeymoons.com is not responsible for losses resulting from cancellations, schedule changes, or delays related to those independently booked arrangements.
16. Self-Service Hotel Bookings: Nuitee as Merchant of Record; Honeymoons.com Customer Support
This Section 16 and Sections 17–19 apply to eligible self-service hotel bookings completed through Honeymoons.com’s booking platform.
For eligible self-service hotel bookings completed through the Site, Nuitée International Ltd. (“Nuitee”) is the merchant of record and booking fulfillment/payment processor. By completing a self-service hotel booking through the Site, you acknowledge and agree that Nuitee may process your payment and issue booking confirmation for the reservation.
Honeymoons.com acts as a facilitator of access to hotel inventory and booking functionality for such self-service hotel bookings and is not the hotel provider.
Honeymoons.com provides customer support for self-service hotel bookings made through the Site. This support may include assistance with booking questions, reservation support intake, and coordination with Nuitee and/or hotel suppliers, subject to the applicable booking terms and supplier/Nuitee policies.
Notwithstanding the foregoing, payment processing and merchant-of-record functions for eligible self-service hotel bookings are handled by Nuitee.
17. Self-Service Hotel Bookings: Supplier and Nuitee Terms; Rule Priority
All self-service hotel bookings are subject to:
- the applicable hotel/supplier’s terms, conditions, policies, rules, and restrictions (including cancellation, no-show, and change policies); and
- the applicable Nuitee terms, conditions, and policies presented in connection with the booking flow.
By completing a self-service hotel booking through the Site, you agree to comply with the applicable supplier/hotel terms and Nuitee terms.
In the event of a conflict between these Terms and the applicable Nuitee terms with respect to payment processing, booking fulfillment, cancellation obligations, or change obligations for a self-service hotel booking, the applicable Nuitee terms shall govern to the extent of that conflict.
18. Self-Service Hotel Bookings: Pricing, Availability, Booking Requests, and Confirmation
Rates, availability, taxes, and fees for self-service hotel bookings may change at any time before a booking is confirmed. Pricing and inventory are subject to availability and may be affected by supplier systems, timing delays, connectivity issues, taxes, fees, and currency conversion.
A self-service booking request is not final until the booking is confirmed and a confirmation is issued through the applicable booking process. Submission of payment information or a booking request does not by itself guarantee booking confirmation.
We reserve the right to correct pricing, display, or system errors and, where permitted by law, to cancel, decline, or void booking requests or reservations impacted by obvious pricing errors, technical errors, duplicate requests, or system malfunctions, subject to the applicable supplier and/or Nuitee terms.
19. Self-Service Hotel Bookings: Changes, Cancellations, Refunds, and Support Process
Changes, cancellations, refunds, credits, and no-show outcomes for self-service hotel bookings are governed by the applicable rate rules, supplier/hotel terms, and Nuitee terms presented during or in connection with booking.
Honeymoons.com provides customer support for self-service bookings, including assistance with support requests and coordination with Nuitee and/or the hotel supplier as applicable. However, Honeymoons.com does not guarantee a refund, waiver, exception, or outcome where the applicable supplier or Nuitee policy does not permit it.
You agree to cooperate with reasonable requests for information needed to assist with support, modification, cancellation, or dispute handling, including booking identifiers, traveler names, and documentation where applicable.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Honeymoons.com and its officers, employees, agents, successors, and assigns shall not be liable for any special, incidental, indirect, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of use, business interruption, personal injury, property damage, or loss of privacy, arising out of or related to the Site, Services, supplier services, third-party services, or bookings, even if advised of the possibility of such damages.
To the maximum extent permitted by law, Honeymoons.com’s total aggregate liability arising out of or relating to the Site, Services, or bookings shall not exceed the greater of: (a) the amount of fees or commissions actually received by Honeymoons.com in connection with the specific booking or transaction giving rise to the claim; or (b) one hundred U.S. dollars (US $100.00), except where prohibited by law.
Nothing in these Terms excludes or limits liability to the extent such liability cannot be excluded under applicable law.
21. Supplier Responsibility; Agency and Platform Role Limitations
Suppliers and travel providers are independent contractors and are not agents, employees, or representatives of Honeymoons.com. Honeymoons.com does not control and is not responsible for the acts, errors, omissions, representations, warranties, breaches, negligence, or misconduct of any Supplier, Nuitee, hotel, airline, tour operator, or other travel provider.
By using the Services and booking travel, you acknowledge that travel services are provided by independent third parties and that Honeymoons.com’s role may be limited to agency assistance, platform facilitation, and/or customer support depending on the booking path.
Supplier decisions, including itinerary changes, cancellations, overbookings, service levels, operational policies, or force majeure decisions, are outside Honeymoons.com’s control.
22. “AS IS” and “AS AVAILABLE” Disclaimer
The Site and Services are provided to you on an “AS IS” and “AS AVAILABLE” basis, with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, Honeymoons.com disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.
Without limiting the foregoing, Honeymoons.com does not warrant that the Site or Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components, or that any information, pricing, or content will always be accurate or current.
23. Force Majeure
Honeymoons.com will not be in breach of these Terms or otherwise liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, extreme weather, flood, fire, explosion, epidemic, pandemic, quarantine, war, terrorism, civil unrest, labor disputes, government acts or omissions, changes in law or regulation, communication/network outages, hosting or infrastructure failures, or supplier failures.
Suppliers and Nuitee may also have force majeure provisions in their own terms. In the event of a force majeure event, suppliers and/or Nuitee may vary, postpone, or cancel reservations or itineraries in accordance with their policies.
THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED FOR ALL TRIPS.
24. Client Conduct; Damage; Indemnification
You are responsible for your conduct and for any damage or loss caused by you or members of your traveling party. Full payment for damage or loss may be due directly to the applicable accommodation owner, manager, or Supplier.
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Honeymoons.com, Campbell Online Media LLC, and their officers, employees, agents, successors, and assigns from and against claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to:
- your breach of these Terms;
- your misuse of the Site or Services;
- fraudulent or unauthorized booking activity under your account;
- your violation of applicable law; or
- your acts or omissions during travel.
Baggage and personal effects are at all times the sole responsibility of the traveler.
25. Travel Insurance
Honeymoons.com may offer access to travel insurance to help protect travelers and their investment in travel. Unless specifically stated, travel insurance is not included in the cost of a booking or itinerary.
The purchase of travel insurance is not required in order to purchase any other product or service offered by Honeymoons.com.
Honeymoons.com is not an insurance carrier and, unless expressly stated otherwise, is not acting as a licensed insurance broker. Honeymoons.com does not guarantee coverage, claim approval, or reimbursement under any insurance policy, and makes no representation regarding the extent of coverage under any policy offered or quoted.
It is your responsibility to review policy terms, conditions, exclusions, and coverage limits.
26. Third-Party Pricing, Fees, and Total Price Disclosures
We may display accommodation pricing and related travel costs sourced from third-party booking platforms, suppliers, and providers (“Third-Party Providers”). While we make reasonable efforts to present accurate pricing information, all displayed pricing is subject to change and may not include all taxes, fees, surcharges, currency conversion, or property-imposed charges until final checkout/confirmation.
The actual price you pay is determined by the applicable Supplier, Third-Party Provider, or merchant of record at the time of booking.
In the event of a discrepancy between pricing displayed on the Site and pricing presented in the final booking flow, the final booking flow pricing will control, subject to applicable law.
27. Travel Advisor Matching and Lead Referral Services
Honeymoons.com may offer a service that allows users to request to be connected with a travel advisor or travel agency for trip planning, quotes, or booking assistance (“Connect With A Travel Advisor”).
By submitting a request through Honeymoons.com to be connected with a travel advisor, you authorize Honeymoons.com to share the information you provide (which may include your name, email address, phone number, destination interests, travel dates, budget, traveler count, and other trip preferences) with one or more third-party travel advisors, agencies, or travel service providers (collectively, “Referral Partners”) for the purpose of contacting you and responding to your request.
Independent Referral Partners. Referral Partners may be independent third parties and are not employees, agents, or representatives of Honeymoons.com (unless expressly stated otherwise in writing). Honeymoons.com does not control and is not responsible for the acts, omissions, services, advice, communications, pricing, availability, policies, or business practices of any Referral Partner.
No Guarantee. Honeymoons.com does not guarantee that:
- you will be matched with a Referral Partner;
- any quote, pricing, availability, or travel option offered by a Referral Partner will be the best available; or
- any Referral Partner will meet your expectations or complete a booking.
Any travel planning, booking assistance, or travel services provided by a Referral Partner are subject to that Referral Partner’s own terms, conditions, privacy policy, and applicable supplier terms.
Your Choice to Proceed. You are under no obligation to book with any Referral Partner. Any decision to communicate with, engage, or book through a Referral Partner is solely between you and that Referral Partner.
Communications Consent. By submitting a request to connect with a travel advisor, you consent to being contacted by Honeymoons.com and/or Referral Partners using the contact information you provide, including by email and telephone, and (where you provide consent as required by applicable law) by SMS/text message, regarding your travel inquiry and related services.
Referral Compensation Disclosure. Honeymoons.com may receive referral fees, commissions, or other compensation in connection with referrals to Referral Partners or bookings made through Referral Partners. Such compensation may vary by partner, product, or booking.
Privacy and Data Use. Information shared with Referral Partners will be handled in accordance with Honeymoons.com’s Privacy Policy and the applicable Referral Partner’s privacy practices. Once your information is shared with a Referral Partner at your request, that Referral Partner’s privacy policy and data practices will also apply.
28. Termination or Suspension of Access
We may terminate or suspend your access to the Site or Services, including your account, at any time and without prior notice, for any reason, including violation of these Terms, suspected fraud, abusive conduct, unauthorized access, or misuse of booking functionality.
29. California Residents; Section 1542 Waiver (Where Applicable)
If you are a California resident, you may waive California Civil Code Section 1542 in connection with releases and limitations in these Terms to the fullest extent permitted by law. Section 1542 provides generally that a general release does not extend to claims that the creditor does not know or suspect to exist at the time of executing the release, which if known may have materially affected settlement.
30. Governing Law; Venue; Time Limit on Claims; Class Action Waiver
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of law principles.
Except to the extent otherwise required by applicable law or by a controlling term of an applicable supplier or merchant of record for a specific booking, you consent to the exclusive jurisdiction and venue of the state and federal courts located in or serving Merrimack County, New Hampshire for disputes arising out of or relating to these Terms, the Site, the Services, or bookings made through Honeymoons.com.
To the extent permitted by law, any claim against Honeymoons.com arising out of or relating to the Site, Services, or bookings must be brought within twelve (12) months after the event giving rise to the claim (or, for travel-related claims, within twelve (12) months after completion of the affected trip), and not later.
To the fullest extent permitted by law, you agree that claims may be brought only in your individual capacity and not as a plaintiff or class member in any class, collective, consolidated, or representative action, and you waive any right to bring or participate in such actions.
31. Changes to These Terms
We reserve the right to modify these Terms at any time in our sole discretion. Updated Terms will be posted on the Site and will be effective when posted unless otherwise stated. Your continued use of the Site or Services after revised Terms are posted constitutes your acceptance of the updated Terms.
32. General Provisions
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be interpreted as closely as possible to reflect the original intent to the extent permitted by law.
These Terms, together with any terms and conditions incorporated by reference (including the Privacy Policy and applicable supplier/Nuitee terms where relevant), constitute the entire agreement between you and Honeymoons.com with respect to the Site, Services, and bookings made through Honeymoons.com, and supersede prior or contemporaneous communications and proposals, whether electronic, oral, or written, relating to the same subject matter.
